NedNambia Holdings Limited and its subsidiaries cordially invite all eligible law firms within the legal fraternity to indicate their interest in providing legal services to NedNamibia Holdings Limited and its subsidiaries (“the NNH Group) in various spheres of law (i.e. Legal collections, litigation, commercial law, conveyancing, property law and labour law).
To ensure that all firms are given an equal opportunity to represent the NNH Group, we wish to advise that all existing Service Level Agreements will be formally terminated as provided for therein, on 31 March 2022. Existing panel attorneys are therefore urged to ensure that new expressions are submitted should they be so interested.
Interested firms must provide the following information indicating that they are qualified to perform the services:
1. Formal Company Profile on company letterhead adequately reflecting inter alia the following:
1.1. Background/history of the firm;
1.2. Type of Entity, being a Sole Proprietor, Partnership, Associate etc.
1.3. Structure/staff compliment of the firm, including a profile on all partners, directors, members or other owners and admitted attorneys/conveyancers employed by the firm, which information must include full names, surnames and identity numbers;
1.4. Areas of expertise and application made for the
following fields of service to be rendered on the Panel: General; Litigation:
Civil and Criminal, Labour, Legal Collections, Commercial and/or Conveyancing;
1.5. Affirmative action practices and ; Affirmative Action Certificate (if applicable);
1.6. Confirmation and proof of Registration with the Financial Intelligence Centre;
1.7. Community involvement;
1.8. Fee structure and/or fee proposal and all items constituting chargeable tasks, including annual increases;
1.9. Collection success rate and age analysis of
collection book; and
1.10. Motivation on why such application should be favourably considered, keeping in mind that reciprocity of business will be an added advantage.
2. Supporting documentation to be provided:
2.1. Fidelity Fund Certificate;
2.2. Certificate of Good standing issued by the:
2.2.1. Social Security Commission;
2.2.2. Law Society of Namibia;
2.2.3. Receiver of Revenue; and
2.2.4. Financial Institution (if trust and business accounts are held with any other Financial Institution than Nedbank).
2.3. Admission certificates in respect of each attorney/conveyancer and confirmation that the said attorney/conveyancer is in the full time employee of the firm;
2.4. Firm’s AML Policy / Programme;
2.5. For admission to the conveyancing panel, the following additional information is required:
2.5.1. Proof of Professional Indemnity (PI) cover to the value of N$ 3 000 000.00 (Three Million Namibian Dollars); alternatively proof of quotation for PI cover. (Please note only firms who are first time applicants to the panel shall be exempted from providing proof of cover. In the event of any appointment being confirmed, such appointment shall however be subject to written confirmation of PI cover);
2.5.2. Applicants shall also be requested to comply with Nedbank’s technological requirements (e.g. installation of software to be compatible with Nedbank);
2.5.3. A written undertaking that a Nedbank trust account will be opened (if not already in existence).
