An inter vivos trust is a trust that is established by the founder(s) during his/her lifetime and is set up according to the specifications of the founder(s). Trustees are nominated by the founder(s) in the trust deed. They are responsible for administering the assets in accordance with the trust deed and relevant legislation. Your beneficiaries, which may include the founder and/or trustee, will benefit from the trust assets. Any beneficiary must be specifically referred to in the Trust Deed registered with the Master of the High Court.
Trusts are constantly under the scrutiny of authorities to ensure everything is above board. It is, therefore, important to make sure that your trust documentation is up to date and correct.
